This agreement ("Terms") constitutes a legally binding contract between TKAWEN as the owner and operator of the Algeria Certify platform, and any entity or individual using the platform, including: certificate issuers, verification parties, and end users. Using the platform constitutes explicit acceptance of these terms.
1. Nature of Service & Legal Capacity
Algeria Certify provides cloud-based technical infrastructure for digital certificate verification, operating as a "Trust Infrastructure" layer.
- Legal capacity: The platform acts as a "Data Processor" with respect to data entered by issuing entities.
- The issuing entity remains the "Data Controller" and is legally responsible for the legitimacy of data collection and its accuracy.
- The platform does not constitute an academic or professional accreditation body, and does not grant any official status to certificates beyond verifying the technical integrity of their digital issuance.
2. Scope of Technical Liability
Algeria Certify commits to providing cryptographic integrity for digital documents per industry standards, and digital verification mechanisms that prevent unauthorized modification after issuance.
The platform bears no substantive liability for:
- The accuracy, correctness, or legitimacy of the academic or professional entitlement of the certificate.
- Any employment or academic admission decision based on verification results.
Full responsibility for certificate content rests with the issuing entity.
3. Issuing Entity Obligations (B2B)
The issuing entity undertakes the following:
- Ensure all uploaded data is based on official and legal records within the institution.
- Protect login credentials and API keys and not share them with unauthorized parties.
- Notify the platform immediately upon discovering any error or forgery.
- Use the Revocation feature when necessary to update a certificate's status.
All operations performed through an institution's account are considered legally issued by that institution.
3b. Purchase & Refund Policy
The credit system operates on a prepaid basis: each credit equals one verified certificate. Credits used for certificate issuance are non-refundable. Unused credits may be refunded within 14 days of purchase in accordance with Algerian Consumer Protection Law No. 18-09.
The platform reserves the right to modify package pricing with a minimum 30-day advance notice. Modifications do not affect previously purchased credits.
4. API Usage Policy
The following is strictly prohibited:
- Reverse engineering the platform or web scraping.
- Flooding servers with unjustified requests or attempting to bypass security systems.
The platform reserves the right to apply rate limiting or suspend any account or API key if activity threatening system stability or security is detected.
5. Indemnification
The issuing entity agrees to indemnify and hold harmless TKAWEN, its employees, and directors from any claims, losses, or damages arising from:
- Entering incorrect or misleading data, or issuing undeserved certificates.
- Violation of applicable data protection laws.
5b. Account Suspension & Termination
The platform may suspend or terminate any account in the following cases: (a) violation of terms of service, (b) issuance of fraudulent or misleading certificates, (c) attempted system intrusion or abuse, (d) inactivity exceeding 12 consecutive months. Users will be notified 15 days before suspension unless the cause is an urgent security matter.
6. Intellectual Property
- Platform ownership: All rights related to the platform, code, algorithms, infrastructure, and trademarks are the exclusive property of TKAWEN.
- Data ownership: Ownership of personal and academic data remains with the issuing entity or the certificate holder, per applicable laws.
7. SLA & Force Majeure
The platform strives to achieve an operational availability rate of 99.9% annually.
The platform bears no liability for delays or interruptions caused by circumstances beyond its control (natural disasters, infrastructure outages, large-scale cyber attacks, regulatory decisions).
8. Limitation of Liability
To the maximum extent permitted by law: TKAWEN bears no liability for indirect or consequential damages. The maximum aggregate financial liability of the platform is limited to the subscriptions actually paid during the twelve (12) months preceding the dispute.
9. Jurisdiction & Amendments
This agreement is governed by the laws of the People's Democratic Republic of Algeria. If amicable dispute resolution fails within 30 days, jurisdiction lies with the competent courts in Annaba, Algeria.
This agreement is governed by Algerian law, including the Algerian Civil Code, Commercial Code, and Executive Decrees No. 20-254 and 21-422 relating to startups and innovative projects. Any dispute arising from this agreement is subject to the jurisdiction of the courts of Annaba, People's Democratic Republic of Algeria.
